General Provisions

The following provisions shall constitute the General By-laws of the Town of Rutland.

By-law Adoption or Amendment; Numbering

By-laws may be adopted, repealed, or amended at any Town Meeting in accordance with law. The Town Clerk shall hereby be authorized, following consultation with the Town Administrator, to assign appropriate numbers to by-law sections, subsections, paragraphs, and subparagraphs, where none are approved by Town Meeting, and, if such are approved by Town Meeting, to make non-substantive, editorial revisions to ensure consistent and appropriate sequencing and numbering, provided that such editorial revisions shall be identified by a footnote or other editorial convention.


Any by-law of the Town of Rutland may be enforced through any lawful means in law or in equity including but not limited to enforcement by criminal indictment or on complaint before the district court pursuant to MGL Ch. 40 § 21, or by non-criminal disposition pursuant to the Town by-law by the same name and MGL Ch. 40 § 21D. Each day that a violation exists shall constitute a separate offense. When enforced hereunder, a fine of up to $300 may be imposed for each violation.

Select Board

The office of the Board of Selectmen shall be referred to as the "Select Board" for purposes of these by-laws; provided, however, that such reference is not intended to, nor shall, make any change to the powers, duties, and responsibilities of such board under law.


The office of treasurer-town collector shall be referred to as the "Treasurer/Collector", for purposes of these by-laws; such office shall have and exercise all the powers and duties of treasurers and collectors under law, including the authority to collect any accounts due, in accordance with MGL Ch. 41 § § 35, 36, 38, and 38A.
